There should be no instant death, that's ridiculous. You'll always have a chance to defend yourself because the same goes for player kills. As soon as you get hit, you turn around and start wailing on your attacker with the aid of the guards. You'll probably win that scenario 75% of the time anyway.
Guards should have good gear and skills, definitely, but they shouldn't be able to deal out any more damage than a player with that same gear and same skills should. In high profile areas, if you kill one guard, two more should come at you during your attempt to escape the city/area, you kill those, then four more come at you. Your best option would be to run, but IMO that's where you need to add some immobilizing skills to the guards' list. No perma-stun BS, mind you, but something that gives them time to catch you and beat on you every so often.
